1. Acceptance of Terms

By using the MiaCat Discord Bot ("the Bot", "we", "us", or "our"), you agree to these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the Bot immediately.

2. Use of the Bot

  • You must be at least 18 years old to use the Bot. By using the Bot, you represent and warrant that you are 18 or older. The Bot handles cryptocurrency wallets, payments, and payouts, which are intended for adults only.
  • You agree to use the Bot in compliance with all applicable laws and regulations, including but not limited to financial regulations regarding cryptocurrency transactions.
  • You will not use the Bot for unlawful, harmful, or abusive purposes.
  • You agree not to attempt to circumvent security measures, exploit vulnerabilities, or interfere with the Bot's operations.
  • You are responsible for maintaining the confidentiality of any wallet addresses or credentials you provide to the Bot.

3. Games and Giveaways

No Buy-In, No Wager: - The Bot's games ("Games") are free-to-enter giveaways. Participating in a Game does not require any purchase, payment, deposit, or wager. No purchase is necessary to enter or to win. - Prizes are funded by the host of a Game or by the Bot and are given away to participants. You do not put your own funds at stake by entering, and you cannot lose money by participating in a Game. - Premium membership is never required to enter or win a giveaway. Premium provides separate convenience features and the ability to host certain Games; it is not a condition of participation. - The Bot uses provably-fair mechanisms where applicable. You may verify Game fairness if you choose to do so.

Prizes and Fairness: - Outcomes are determined by the Bot's algorithms and, where applicable, provably-fair randomness. There are no guarantees of winning any prize, and past results do not predict future outcomes. - Because Games are giveaways with no entry cost, participation carries no financial risk to you. Any cryptocurrency prizes you receive are subject to the cryptocurrency terms in Section 4. - The Bot reserves the right to disqualify entries, or to suspend or terminate accounts, that abuse giveaways - for example, using alternate accounts to claim multiple entries.

4. Cryptocurrency Transactions and Payments

Cryptocurrency Payments: - The Bot accepts multiple cryptocurrencies for premium memberships, payouts, and transactions, including but not limited to: Solana (SOL), Bitcoin (BTC), Litecoin (LTC), XRP, Ethereum (ETH), Dogecoin (DOGE), USDC, USDT, and others. - All cryptocurrency transactions are irreversible. Once a transaction is confirmed on the blockchain, it cannot be undone. You acknowledge this and accept full responsibility for any transaction errors. - You are solely responsible for ensuring accuracy of wallet addresses. Funds sent to incorrect addresses cannot be recovered. - Exchange rates between fiat currencies and cryptocurrencies are subject to market fluctuations. The price quoted at the time of transaction initiation may differ from the final transaction price due to network conditions and exchange rate volatility. - Transaction fees imposed by blockchain networks are the responsibility of the user and are deducted from the amount sent or added to the total cost as applicable.

Premium Membership: - Premium membership is purchased with cryptocurrency and provides discounted access to select features and games. - Premium pricing is calculated in USD and converted to cryptocurrency at the time of purchase using real-time exchange rates. - Premium membership is non-refundable except at the sole discretion of the Bot administrators. If a transaction fails due to network conditions or user error, no refund will be issued unless the Bot administrators determine a refund is appropriate. - Premium status is account-specific and tied to your Discord user ID. Premium benefits are not transferable. - For purchases exceeding $100 USD, the Bot administrators may review the transaction before granting premium status to prevent fraud or abuse.

User Wallet Addresses: - You may register cryptocurrency wallet addresses for payouts and receiving funds through the Bot. The Bot stores these addresses in its database. - You are responsible for the security of your wallet addresses. Do not share your wallet addresses with untrusted parties through the Bot. - The Bot does not guarantee the security of stored wallet addresses. While we use industry-standard security measures, we cannot guarantee protection against all attacks. - You may modify your registered wallet address, but rate limiting applies (typically 1 address change per hour, up to 3 per 24 hours).

Payouts and Transfers: - Cryptocurrency payouts from game winnings, affiliate commissions, or other sources are automatically transferred to your registered wallet address. - Once a payout transaction is initiated and confirmed on the blockchain, it is irreversible. Any discrepancies in payout amounts or wallet addresses cannot be corrected after confirmation. - The Bot is not responsible for delays, failures, or issues with blockchain networks that may prevent or delay payout transactions. - Payouts are processed at the discretion of the Bot administrators and may be suspended if account activity appears fraudulent or violates these Terms.

5. Affiliate System and Commissions

  • The Bot tracks affiliate commissions and referral relationships. Affiliate data, including wallet addresses, is stored in our database.
  • Affiliate commissions are calculated based on the activities of referred users and are paid out in cryptocurrency to the wallet address associated with your affiliate account.
  • Commissions are non-guaranteed and depend on the performance of referred users. Affiliate rates and terms may change at any time at the sole discretion of the Bot administrators.
  • The Bot reserves the right to suspend or terminate affiliate accounts for fraudulent activity, ToS violations, or other reasons at its discretion.

6. Message Processing and Data Handling

  • Messages you send to the Bot are processed by a third-party Large Language Model (LLM) service to generate responses.
  • Your messages may be transmitted to and processed by these third-party providers (e.g., OpenAI through Azure, Google Gemini, Anthropic, Claude, etc.).
  • By default, your messages and context may be stored to improve the Bot's responses and for record-keeping purposes.
  • You may opt out of having your messages stored for conversation history and context at any time by using the %optout command. When opted out, your messages will not be retained for future context, but may still be processed in real time to generate replies and may be logged for procedural or security requirements.
  • You may opt back in at any time by using the %optin command.
  • Messages processed by the Bot may include cryptocurrency wallet addresses, transaction data, and other sensitive information. You should not transmit sensitive information through the Bot's LLM processors if you do not consent to third-party processing.

7. Third-Party Services and Integrations

  • The Bot integrates with multiple third-party services for cryptocurrency transactions, data storage, and payments:
  • Blockchain Networks: Solana, Bitcoin, Litecoin, Ripple (XRP), Ethereum, and others
  • Exchange Services: Kraken, FixedFloat, and other cryptocurrency exchanges
  • Data APIs: CoinMarketCap, and other blockchain/cryptocurrency data providers
  • Cloud Services: Microsoft Azure (Cosmos DB, Azure Functions, storage)
  • LLM Services: OpenAI (Azure variant), Anthropic, Google, and others
  • These third-party services have their own Terms of Service and Privacy Policies, which also govern your data and transactions. You are responsible for reviewing and understanding their terms.
  • The Bot is not responsible for outages, failures, or security incidents affecting third-party services.
  • By using the Bot, you consent to your data being transmitted to and processed by these third-party services as necessary for Bot functionality.

8. Data Storage and Security

  • User data including Discord user IDs, usernames, roles, game statistics, wallet addresses, transaction history, and prediction data is stored in multiple locations including local files, SQLite databases, and Azure cloud storage.
  • The Bot uses encryption and other security measures to protect stored data, but no method of storage or transmission is 100% secure.
  • The Bot does not guarantee protection against unauthorized access, hacking, or data breaches. You acknowledge these risks and accept responsibility for the security of your account.
  • In the event of a data breach or security incident, the Bot administrators will make reasonable efforts to notify affected users, but cannot guarantee timely or complete notification.

9. Prohibited Activities

You agree not to: - Use the Bot for money laundering, sanctions evasion, or other illegal financial activities - Attempt to exploit game mechanics or blockchain transactions for fraudulent gain - Use the Bot to facilitate transactions on behalf of others or for commercial purposes without authorization - Use the Bot in violation of any applicable financial regulations or cryptocurrency laws in your jurisdiction - Attempt to reverse, hack, or manipulate cryptocurrency transactions processed through the Bot - Share credentials, exploit vulnerabilities, or circumvent rate limiting and security measures

10. Limitation of Liability

  • The Bot is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any damages, losses, or liabilities arising from your use of the Bot, including but not limited to:
  • Financial losses from cryptocurrency transactions, premium purchases, or payouts
  • Irreversible cryptocurrency transfers or transaction errors
  • Data loss, theft, or unauthorized access
  • Third-party service failures or outages
  • Regulatory or legal consequences of using the Bot in your jurisdiction
  • This limitation applies regardless of the cause of action, whether based on warranty, contract, tort, or any other legal theory.
  • Some jurisdictions do not allow limitation of liability, in which case this clause may not apply to you.

11. Assumption of Risk

  • You acknowledge that cryptocurrency transactions and the use of third-party financial services carry inherent risks.
  • You assume full responsibility for these risks and agree that the Bot, its operators, and affiliated parties are not liable for losses resulting from these risks.
  • You have the knowledge and expertise to make informed decisions about cryptocurrency transactions and gaming.

12. Termination of Access

  • The Bot administrators reserve the right to suspend or terminate your access to the Bot at any time, for any reason, including but not limited to:
  • Violation of these Terms of Service
  • Suspected fraudulent activity
  • Regulatory or legal concerns
  • Violation of Discord Terms of Service
  • Harmful or abusive behavior
  • Upon termination, you may request a payout of any remaining balance in your account, which will be processed to your registered wallet address within a reasonable timeframe.

13. Changes to Terms

  • We may update these Terms of Service at any time. When the terms are updated, the Bot will directly notify users that its terms have been changed before its next response to any command.
  • Continued use of the Bot after changes are posted constitutes acceptance of the new terms.
  • For significant changes, especially those affecting financial or gaming terms, we may require explicit acceptance before continued use.

14. Disclaimers

  • Regulatory Status: Cryptocurrency and gaming regulations vary by jurisdiction. You are responsible for determining whether use of the Bot is legal in your location.
  • Not Financial Advice: The Bot provides real-time cryptocurrency price data and prediction markets for entertainment purposes only. This is not financial advice. Do not make investment decisions based on Bot predictions or suggestions.
  • Market Volatility: Cryptocurrency prices are highly volatile. The value of any cryptocurrency can fluctuate dramatically and suddenly. Past performance is not indicative of future results.
  • Affiliate Relationships: The Bot may have affiliate or referral relationships with third-party services. These relationships may affect the recommendations or services promoted through the Bot.

15. Jurisdiction and Governing Law

  • These Terms are governed by applicable laws, though enforcement may be limited by jurisdictional constraints.
  • Any disputes related to the Bot or these Terms should be resolved through good-faith discussion first.
  • You acknowledge that different jurisdictions have different regulations regarding cryptocurrency, gaming, and financial services, and you are responsible for ensuring compliance with your local laws.
